Goods to be disposed of by spoilage
Article 52:
1. Goods that are disabled by decision or approval of the customs administration due to their quality, condition or violation of the laws in force shall be deemed to be worthless. The destruction process is carried out in the presence of representatives of the customs administration, the port administration, the concerned parties and the relevant ministries (environment, agriculture, economy, etc.).
For the purposes of paying port fees, the goods may also be considered damaged by reference to the report of an expert approved or assigned by GEPB and with the approval of the PDG.
2. Fees shall be collected before the completion of the destruction process in accordance with the following division of cargo categories:
A- Container goods:
GEPB only collects a port fee of $50 (not including handling) for each container, whatever its size, in addition to price of the seal.
In this case, the container is exempted from storage fees, but the concerned parties bear the actual costs of the destruction process, such as the container handling (C9), or goods handling, electrical consumption (in case of Reefers), etc. In this case, Article 22 does not apply for the electrical consumption fees, but an exceptional tariff is applied as follows: $ 33 per day for container 20’, and $37 per day for container 40’.
B- General Cargo:
A transit fee shall be collected for general goods deposited in public warehouses, on quays or in yards, and duly destroyed, with a minimum of $50. This fee includes the handling process for delivery in the case of goods deposited in public warehouses, while those deposited on the Quays or in the yards are not included in the minimum fee.
Damaged goods are exempt from storage fees.
For private warehouses in the free zone, a fee of $50 is charged for each entry request, regardless of the weight of the goods. This fee does not include the handling process for delivery.
C- Destroying, cutting or pressing vehicles:
A transit fee is collected for each vehicle that is cut or pressed with a minimum of $60. A lump sum storage fee of $100 is also charged for each vehicle.
3- An entry fee of ($15) shall be collected with each destruction bill.
4. A security deposit shall be deposited at the Port cashier office for the value of the fees due on the goods if they are not damaged, in parallel with the payment of the destruction bill, as a guarantee until the destruction process is completed and a duly organized and signed destruction report is presented.
5- In the event of destruction outside Lebanese territory, the concerned parties must present a destruction certificate issued by an official authority and certified by the Lebanese embassy (or consulate) in the country concerned. The statement must be in French or English or translated to Arabic language by a sworn translator.
